Terms of Use and Sale

Last updated: 2 November 2026

In short. B·SET keeps the best moments of your set. The free plan stays free. PERFORM is a subscription bought through the App Store or Google Play, which you can cancel anytime from your phone settings. Your moments belong to you. You are responsible for what you film and post (people, music, venue). B·SET is not a backup: keep a copy of what matters to you.

1. Who publishes B·SET

The B·SET app and the b-set.app website are published by Adrien Bisset, sole proprietor (entrepreneur individuel), SIREN 879 390 284, located at 12 rue du Général Camou, 75007 Paris, France ("B·SET", "we").

To reach us: the contact form, the address or by phone at +33 6 38 62 29 87.

2. Purpose and acceptance

These terms govern your use of the B·SET app and, if you subscribe, the sale of the PERFORM subscription. By creating an account or using the app, you accept them. If you don't, please don't use B·SET.

B·SET is meant for DJs and artists using the app for their activity, whether as consumers or professionals. Consumer protection rules apply whenever you act as a consumer.

3. Definitions

App
The B·SET mobile app for iOS and Android.

The mode in which the app continuously keeps, on your phone, a rolling memory of about 15 seconds of video and sound.
Moment
A video and sound excerpt saved by the app: the seconds before the trigger and what follows.
Set
A night or session during which you use the app; your moments are organised by set.
CAPTURE
Manually triggering a moment with a tap.
AUTO
Automatically triggering a moment when the app detects, through the microphone, a reaction from the crowd.

Store
Apple's App Store or Google Play, through which you download the app and buy PERFORM.

4. Access and account

You must be at least 18 years old to use B·SET. The app is designed for venues (clubs, parties) that are generally adults-only.

You sign in only with Apple or Google: B·SET does not handle passwords. You are responsible for the security of your Apple or Google account and your phone. Your account is personal: don't share it. If you think someone is using it without your consent, let us know.

The app requires a compatible phone, an up-to-date operating system and, for some features, an internet connection, at your own cost.

5. The service and plans

In WATCH mode, B·SET continuously keeps a rolling memory of about 15 seconds on your phone. When you trigger a moment (CAPTURE) or when the app detects a crowd reaction (AUTO), it saves the seconds before and what follows. Your moments are organised by set and export ready to post, with a B·SET banner showing the venue or night and the date.

Free plan

PERFORM (subscription)

Everything in the free plan, plus:

Changes to the service

We keep improving B·SET (new features, fixes). If a change significantly reduces a feature included in your current subscription, we tell you in advance and you can cancel at no cost before it applies.

6. PERFORM subscription

6.1 Purchase

PERFORM is bought in the app, through your Apple or Google account, as a monthly or yearly subscription. The price including taxes, the duration and any trial terms are shown by the store before you confirm. Payment is handled by Apple or Google: B·SET never receives your payment details. The store's terms also apply to the purchase.

6.2 Free trial

If a free trial is offered, its length is shown before purchase. At the end of the trial, the paid subscription starts automatically unless you cancel at least 24 hours before the trial ends (or within the period set by your store).

6.3 Automatic renewal

The subscription renews automatically for the same period, at the then-current price, unless cancelled at least 24 hours before the end of the current period (or within the period set by your store). Your Apple or Google account is charged on renewal.

6.4 Cancellation

You can cancel at any time from your phone settings:

Cancellation takes effect at the end of the period already paid: you keep PERFORM until then, then go back to the free plan. Deleting the app or your B·SET account does not cancel the subscription: remember to cancel it in your store.

6.5 Refunds

As payment goes through Apple or Google, refund requests are made to them under their rules (Apple: reportaproblem.apple.com; Google: from Google Play). B·SET cannot directly refund a store purchase. This does not limit your statutory rights (section 13).

6.6 Right of withdrawal

As a consumer, you generally have 14 days to withdraw from a distance purchase. When you ask for immediate access to PERFORM (without waiting for that period to end), you agree that performance starts right away and, to the extent permitted by law, you acknowledge that you lose your right of withdrawal for the digital content and features supplied. Where that right still applies, you exercise it with Apple or Google (see 6.5) or by writing to us via the contact form; we will help you get any refund you are entitled to.

6.7 Price changes

We may change the price of PERFORM. A new price never applies to the current period. For an existing subscription, you are told at least 30 days in advance (by your store and/or by us) and can cancel before the new price applies. If your store requires your consent to a price increase, the subscription only renews at the new price with that consent.

6.8 Founder price

We may offer a reduced "founder" price to a few early users, by invitation or as a limited offer. It is personal, non-transferable, and kept for as long as your PERFORM subscription stays active without interruption. If you cancel and subscribe again later, the then-current price applies unless the offer says otherwise.

7. What B·SET does not guarantee

We do our best to make B·SET work well in clubs, but some limits come with the nature of the service:

8. Your moments

You remain the owner of your moments and the content you add (night name, venue, etc.).

You only grant us the licence needed to run the service for you: to store, process (for example to add the banner or titles), copy, display and deliver your moments to you, for as long as they are stored with us, worldwide, free of charge. This licence ends when the moment or your account is deleted.

We do not use your moments in our marketing, publish them or sell them. We would only do so with your express consent, asked case by case.

The B·SET banner added on export is part of the service: you may post your moments with it.

9. Your responsibility when filming and posting

You film and post on your own behalf. You alone are responsible for:

If a third party makes a claim against us because of content you filmed or posted in breach of these rules, you will indemnify us against that claim, within the limits set by law.

10. Prohibited uses

You may not use B·SET to:

11. B·SET intellectual property

The B·SET name and trademark, logo, app, code, interfaces, banner and website are protected and belong to the publisher. We grant you a personal, non-exclusive, non-transferable right to use the app for your own use while these terms apply. Any other use requires our written consent.

12. B·SET's liability

We are responsible for the proper performance of the service under these terms and the law.

To the extent permitted by law, our liability is limited to direct and foreseeable damage caused by our fault, and capped at the total amount you paid for B·SET in the 12 months before the event giving rise to the claim. We are not liable for moments not captured or lost because of the limits described in section 7, misuse, or force majeure.

These limits do not apply in case of gross negligence or wilful misconduct, personal injury, or to anything that consumer law prohibits limiting or excluding. They do not deprive consumers of their statutory guarantees.

13. Legal guarantee of conformity

As a consumer, you benefit from the legal guarantee of conformity for digital content and services (articles L.224-25-1 et seq. of the French Consumer Code, and the equivalent rules of your EU country). For the PERFORM subscription, which is supplied continuously, it covers lack of conformity appearing during the whole subscription; for the free app, it applies as provided by law.

If something is wrong, write to us via the contact form. You are entitled to have it brought into conformity free of charge within a reasonable time; failing that, to a price reduction or termination of the contract, as provided by law.

14. Notices and moderation (DSA)

B·SET is a hosting service under the EU Digital Services Act (DSA): it stores your moments for you. It is not a public distribution platform: your moments are not visible to other users.

Single point of contact

For authorities, users and anyone concerned: or the contact form. Accepted languages: French and English.

Moderation rules

We do not look at your moments and do not carry out general monitoring. We use neither automated content moderation nor facial recognition. We act on notices, or at the request of an authority, under the law and section 10.

Reporting illegal content

Use the contact form with the subject "Content report", stating:

We acknowledge receipt, review the notice diligently and objectively, and inform you of our decision and the available remedies.

Decisions and statement of reasons

If we remove content, restrict access to it or suspend an account, we inform the user concerned, at the latest when the decision takes effect, with a clear explanation: the facts, the ground (law or these terms) and possible remedies (complaint to us via the contact form, mediation, competent courts). Manifestly unfounded notices submitted repeatedly may no longer be processed, after a warning.

Serious offences

If we become aware of information giving rise to a suspicion of a criminal offence threatening the life or safety of persons, we promptly inform the competent authorities.

15. Suspension and termination

On your side: you can stop using B·SET at any time and delete your account in the app (My account › Delete my account). Remember to cancel PERFORM in your store too (section 6.4).

On our side: in case of a serious breach of these terms (especially section 10) or at the request of an authority, we may suspend or close your account. Except in urgent cases or where the law requires otherwise, we tell you beforehand, explain why and give you a chance to respond. If we close your account through no fault of yours while a paid subscription is running, we help you get a refund for the unused period.

End of service: if we shut B·SET down, we give you at least 30 days' notice so you can export your moments.

16. Changes to these terms

We may change these terms, for example to follow changes in the service or the law. For any significant change, we notify you at least 30 days in advance in the app or by email. If you disagree, you can delete your account and cancel your subscription before the change takes effect. The current version is always available on this page.

17. Personal data

How we handle your data is described in the privacy policy.

18. Complaints, mediation and governing law

For any complaint, please write to us first via the contact form: we look for an amicable solution.

If you are a consumer and your written complaint has not been resolved, you may refer the matter free of charge to the consumer mediator we are registered with (articles L.611-1 et seq. of the French Consumer Code): Société Médiation Professionnelle (SMP), Alteritae, 5 rue Salvaing, 12000 Rodez, France, www.mediateur-consommation-smp.fr. Mediation is possible within one year of your written complaint.

These terms are governed by French law. If you are a consumer, you also benefit from the mandatory protections of the EU country where you live. Failing an amicable solution, the dispute will be brought before the competent court; as a consumer, you may bring it before the courts where you live.

19. Miscellaneous

If a clause is held invalid, the others remain in force. Not enforcing a right does not waive it. This English version is a translation: in case of discrepancy, the French version prevails, to the extent permitted by law.
